Prepublication Review and Counseling

The Firm offers prepublication advice to clients concerning news reports, editorial expression, letters to the editor and news gathering techniques, including analysis of potential liability and reduction of that risk.


Subpoenas to Media

Publishers and journalists frequently are served subpoenas by government agencies and private litigants in connection with investigations and civil and criminal cases. Subpoenas directed to news organizations, often for unpublished information and confidential sources protected by the California Shield Law, threaten First Amendment interests and the independence of the press. Dietrich, Glasrud, Mallek & Aune has represented numerous journalists and media organizations who resist production of information protected by the Shield Law and First Amendment principles.


Defamation and Related Defense

Dietrich, Glasrud, Mallek & Aune defends its media clients against allegations of defamation, invasion of privacy, misappropriation of name, likeness or right of publicity, and other claims alleging reputational damage arising from publication, broadcast or content distribution. These cases may arise from radio, television or press reports, internet publications, and other forms of media distribution.


News Gathering Liability

We regularly advise clients on claims arising out of news gathering activities. Journalists and publishers may be sued for investigative techniques such as hidden cameras, ride-alongs with police, and breach of confidentiality agreements. Claims may include breach of contract, invasion of privacy, trespass, violation of wiretap laws, fraud, and intentional infliction of emotional distress, among others.
